Third party facilities usage - guidelines

These Terms of Use ("Terms"), together with any other documents referred to herein, sets forth the terms and conditions governing your use of the websites and apps (the "Website") owned or operated by Talent Share Corporation and its parents, subsidiaries, and affiliates (collectively, "TSC, us, our, or we"), including www.talent-share.com as well as the provision, access, and use of all services, products, and platforms (collectively, the "Services") offered by TSC to you as an individual consumer. The third-party facility is referred as ("facility"). THESE TERMS APPLY TO ALL USERS, BOTH TALENT PROVIDERS AND SERICE SEEKERS.

IF YOU DO NOT ACCEPT THESE TERMS, YOU MAY NOT ACCESS OR USE THE WEBSITE OR SERVICES. PLEASE NOTE THAT THESE TERMS REQUIRE ANY DISPUTE BETWEEN YOU AND TSC TO BE RESOLVED ON AN INDIVIDUAL BASIS, NOT BY ANY CLASS OR REPRESENTATIVE ACTION.

Please read these Terms carefully before using the Website or signing up for the Services. By using the Website and/enrolling for the services or programs, you accept and agree to these Terms. Certain provisions of these Terms may be expressly superseded by designated legal notices or terms posted on particular pages on the Website or in connection with the Services, and those notices or terms will be incorporated into these Terms by reference.

1. SERVICES

The Services include both free services and paid services. This policy applies to both Talent providers and Talent seekers. All users, including Talent providers and Talent seekers must agree to this policy. No user will be allowed to continue on the TSC portal without agreeing to this policy.

2. PRIVACY POLICY, COOKIE POLICY AND CODE OF CONDUCT

Use of the talent-share.com website, iOS and Android apps, are subject to our privacy policy, cookie policy and our code of conduct, which are incorporated into these Terms by reference. A copy of our Privacy Policy is available at www.talent-share.com. Please review our Privacy Policy to see how we collect, store, and use your personal information/data. Also, a copy of our Code of Conduct is available at www.talent-share.com

3. THIRD PARTY FACIILITIES UTILIZATION – GUIDELINES.

To whom it is applicable:

These guidelines apply to both Talent providers and Talent seekers.

Scope of TSC for facility:

TSC has no role or intervention in this regard. TSC is not responsible for any expenses spent for utilization of the facility by Talent seekers or Talent providers, and it is not in the TSC's preview. TSC is only collaborating and introducing the talent providers to talent seekers and not into suggesting or working with any facility owners. This is completely between the Talent provider and Talent seekers and TSC is not involved in any aspect.

Facility recommendation and approval:

It is the talent provider who should be suggesting and deciding a facility where talent provider wants to provide his service. It is the talent providers decision to choose the facility. Talent provider should publish the facility details in the program, like facility name, address, email id and phone number of the facility. Talent seekers who agree to the facility only sign up for the given program. If a talent provider mentions the given facility details in the program and the talent seekers signs up for the given program, it is assumed that the talent seeker agrees to the given facility utilization, and willing to pay for the facility services. If the talent seeker does not like the facility for whatever be the reason, he/she should not sign up for the given program.

Facility usage and facility terms and conditions:

Talent provider and Talent seekers are responsible for the sign up of the facility services and they should be abiding to the rules and regulations stipulated by the facility owners. TSC is not involved, obligated, liable for anything that is between the Talent users and the facility.

Contract agreement with the facility:

It is the talent provider and talent seeker who should sign with the facility and get their services. TSC is not involved and does not come under TSC purview and not liable for any agreement by the users with facility providers.

Changes to the facility location and new facility:

It is the Talent provider who makes the decision on what facility he/she wishes to use. TSC has no involvement in the decision made by the Talent provider.

Equipment rental, or any rentals, memberships, subscriptions, entrance fees, anything that is paid for using at the facility by Talent users:

Both talent providers and talent seekers are responsible for paying and utilizing what they paid for. TSC has no involvement whatsoever in this regard.

Facility utilization cost, expenses:

Facility utilization cost can be done in two ways. In the first case, the talent provider can rent a facility and then incorporate that expense into the program enrollment cost. In other case, the talent provider is also a user of the facility and he/she too pays for the facility utilization along with the service seekers. In this scenario the service seekers agree to pay directly to the facility and make their reservation. Any expense that is made by talent seekers is directly made to facility owners and administrators. TSC has no role in this regard.

Insurances:

Talent providers and Talent seekers should get their own insurances as described and mentioned by the facility providers. TSC is not responsible, liable and this does not come under TSC scope. This is purely between the users and their facility providers. TSC do not have any relationship with the facility providers.

Injury, damage, accident, death:

TSC is not liable for any loss, either material and human loss when the users utilize the facility and its services. TSC is not the provider and the users should be directly liable for this. This does not come under TSC scope.

Damage to the facility property:

Talent providers and Talent seekers who used the facility and who signed up are responsible for any damages. TSC is not involved and is not responsible. Also, this does not come under TSC scope.
